Terms of Service

Effective date: avril 2024 · Last updated: Juin 2026

1. Introduction and acceptance These Terms of Service (the "Terms") govern your access to and use of the website [your store URL] and any digital products, downloadable content, or online services offered by The Wild Zoomies ("we", "us", or "our"), operated by [legal entity name], a company registered in France under SIREN/SIRET No. [SIRET], with its registered office at [registered address], France (VAT No. [intra-EU VAT number]). By accessing our website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our site or purchase our products.

2. Definitions "Customer" or "you" means any person who browses the site or purchases a product from us. "Digital Product" means any non-tangible product delivered electronically, including downloads, files, online resources, memberships, or access to digital content. "Order" means a request by you to purchase one or more Digital Products. "Site" means the website www.thewildzoomies.com and its sub-domains.

3. Eligibility You must be at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract in order to place an Order. By ordering, you represent that you meet these requirements and that the information you provide is accurate and complete.

4. Accounts Some features may require you to create an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us immediately at [contact email] if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

5. Digital products and delivery Our products are digital and delivered electronically — typically via a download link, an email, or access through your account. We do not ship physical goods. After your payment is confirmed, access or download instructions are provided [immediately / within X hours] to the email address associated with your Order. You are responsible for having the hardware, software, and internet connection needed to download and use the Digital Product. We are not responsible for failures caused by your equipment or connection. If a download link fails or you do not receive access, contact us and we will help.

6. Prices and payment All prices are displayed on the Site in US Dollars (USD). Depending on your location, VAT or other taxes may apply and will be shown before you confirm your Order. We reserve the right to change prices at any time, but changes do not affect Orders already confirmed. Payment is processed securely through our third-party payment providers (e.g., Shopify Payments and/or [provider]). We do not store your full card details. Your Order is confirmed only once payment is successfully authorized.

7. Right of withdrawal and its exception for digital content Under Articles L221-18 et seq. of the French Consumer Code, consumers in the EU normally have fourteen (14) days to withdraw from a distance contract without giving a reason. However, pursuant to Article L221-28 13° of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium where performance has begun with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal. By downloading or accessing a Digital Product immediately after purchase, you expressly request immediate performance and acknowledge that you waive your 14-day right of withdrawal once the download or access has started. Where the right of withdrawal does apply (for example, before download or access has begun), you may exercise it by contacting us at [contact email]. We will reimburse eligible payments within 14 days using the original payment method.

8. Licence to use digital products Unless stated otherwise, your purchase grants you a personal, non-exclusive, non-transferable, revocable licence to use the Digital Product for your own personal, non-commercial use. You may not resell, redistribute, sublicense, publicly share, or commercially exploit the Digital Product without our prior written consent. All rights not expressly granted are reserved by The Wild Zoomies.

9. Acceptable use You agree not to: copy, reproduce, or distribute Digital Products beyond the licence granted; circumvent any access control, watermark, or technical protection measure; use the Site or products for any unlawful, fraudulent, or harmful purpose; or attempt to gain unauthorized access to our systems or interfere with the Site's operation.

10. Intellectual property All content on the Site and within the Digital Products — including text, graphics, logos, the "The Wild Zoomies" name and brand, images, and files — is owned by The Wild Zoomies or its licensors and is protected by intellectual property laws. Purchasing a Digital Product grants you a licence to use it as described above; it does not transfer ownership of any intellectual property to you.

11. Legal guarantee of conformity Consumers benefit from the legal guarantee of conformity (garantie légale de conformité, Articles L217-1 et seq. of the French Consumer Code), under which digital content must conform to the contract. If a Digital Product is defective or does not conform, contact us at [contact email] and we will provide a replacement, a corrected file, or a refund as required by law. These rights are independent of, and additional to, any commercial guarantee we may offer.

12. Limitation of liability To the fullest extent permitted by law, The Wild Zoomies shall not be liable for indirect or consequential loss, loss of data, or loss of profit arising from the use of, or inability to use, the Site or Digital Products. Nothing in these Terms limits our liability for fraud or any liability that cannot be excluded under applicable law, including statutory consumer rights.

13. Personal data and privacy We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés). Details of what we collect, why, and your rights (access, rectification, erasure, portability, objection) are set out in our Privacy Policy. You may exercise your rights or contact us at [contact email].

14. Force majeure The Wild Zoomies is not liable for any failure or delay in performing its obligations caused by events beyond its reasonable control, including outages, cyber-attacks, failures of telecommunications or hosting providers, or other events of force majeure within the meaning of Article 1218 of the French Civil Code.

15. Changes to these Terms We may update these Terms from time to time. The version applicable to your Order is the one in force at the date of your Order. Material changes will be posted on this page with a new "Last updated" date.

16. Governing law and dispute resolution These Terms are governed by French law. In the event of a dispute, please contact us first at [contact email] so we can seek an amicable solution. In accordance with Articles L611-1 et seq. of the French Consumer Code, consumers may use the free consumer mediation service [name and contact details of the appointed mediator] before bringing any claim before a court. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Failing an amicable resolution, the competent courts shall be those designated by the applicable rules of jurisdiction.
